Acceptance of these terms
By creating a FUNEL account, accessing the platform, or clicking to accept, you agree to be bound by these Terms of Service and the policies they reference. If you do not agree, you may not use the service. If you accept on behalf of a company, you confirm you have authority to bind it.
These terms form a binding agreement between you (the "customer") and FUNEL. They incorporate by reference the documents listed below, which together describe your full relationship with the service:
- The Acceptable Use Policy, which governs how the platform may be used.
- The Privacy Policy, which explains how personal information is processed.
- The Data Processing Addendum (DPA), available on request and signed where required.
Where any conflict exists between these terms and a referenced policy, these terms control unless the referenced document expressly states otherwise.
Description of the service
FUNEL is a B2B sales-intelligence platform that finds verified business contact records from publicly available professional and business information, enriches them with AI, runs email outreach campaigns, and syncs results to your CRM — all within a single workspace. The service is provided on a subscription basis and is intended for legitimate business-to-business use.
Core capabilities include:
- Discovery of company and contact records drawn from public data sources, professional networks, local business directories, and other public web sources.
- AI-assisted enrichment that adds context to business and contact records.
- Outbound email outreach and sequencing tools.
- Integrations that sync records and activity to your CRM and other connected systems.
We may add, change, or remove features over time. We aim for high service availability, but the platform is delivered on an ongoing basis and specific features are not guaranteed to remain unchanged.
Eligibility and your account
To use FUNEL you must be at least 18 years old, capable of forming a binding contract, and using the service for business purposes. You must provide accurate, current, and complete information when you register and keep that information up to date. You are responsible for everything that happens under your account.
Your responsibilities
- Provide accurate registration and billing information and update it when it changes.
- Keep your login credentials confidential and do not share access with unauthorized parties.
- Be responsible for all activity that occurs under your account, including by your team members and authorized users.
- Notify us promptly at support@funel.to if you suspect any unauthorized use of your account.
We may refuse registration, or suspend or close an account, if the information provided is inaccurate, incomplete, or being used in breach of these terms.
Subscriptions, credits, billing, and cancellation
FUNEL is offered on a month-to-month basis with a 14-day free trial. You can cancel anytime and keep access through the end of your current billing cycle; subscription fees are charged in advance and are not pro-rated on cancellation. Credits are prepaid and are non-refundable once consumed.
Free trial
New customers may be offered a 14-day free trial. Unless you cancel before the trial ends, your subscription begins automatically and your payment method is charged for the first billing cycle. We may modify or withdraw trial offers at any time.
Subscriptions and renewals
- Subscriptions are month-to-month and renew automatically at the start of each billing cycle until cancelled.
- Fees are billed in advance through our payment processor using the payment method on file.
- We may change pricing with reasonable advance notice; changes take effect on your next renewal.
Credits
- Credits are prepaid and used to access certain features such as record discovery and enrichment.
- Consumed credits are non-refundable.
- Unused credits may expire as described in your plan.
Cancellation and refunds
- You can cancel at any time from your account settings or by contacting support@funel.to.
- On cancellation you retain access until the end of the current billing cycle, after which your subscription ends and renewal stops.
- Except where required by law, subscription fees already paid and credits already consumed are non-refundable.
Acceptable use and customer compliance
You must use FUNEL only for lawful business purposes and in line with our Acceptable Use Policy. You are solely responsible for how you use exported contact data and for ensuring your outreach complies with all laws that apply to you, including anti-spam, marketing, and data-protection rules.
Your Acceptable Use obligations include not using the platform to send unlawful, deceptive, or unsolicited messages outside what the law permits, not attempting to circumvent technical limits or security, and not reselling or redistributing data in violation of these terms or applicable law.
Intellectual property
FUNEL owns the platform — including its software, design, models, and brand — and grants you a limited, non-exclusive, non-transferable right to use it during your subscription. You own the inputs you bring to the service, such as your lists, content, and CRM data, and you grant us a limited license to process them to provide the service.
Our rights
All rights, title, and interest in the FUNEL platform, including its software, user interface, AI enrichment systems, documentation, and trademarks, remain ours. No rights are granted except the limited license expressly described here. You may not copy, reverse engineer, resell, or create derivative works from the platform.
Your rights
You retain ownership of the content and data you submit. You grant FUNEL a worldwide, royalty-free license to host, process, and transmit that content solely to operate and improve the service and to provide the features you use. We may use aggregated and de-identified data to maintain and enhance the platform.
Customer data and privacy
We process personal information as described in our Privacy Policy and, where we act as your processor, under our Data Processing Addendum (DPA). Data is encrypted in transit using TLS and at rest using AES-256, supported by GDPR-compliant design and CCPA-aligned practices.
Key points about how data is handled:
- For B2B contact data we process about third parties, our lawful basis is legitimate interest, with a clear right to object and opt out.
- FUNEL does not sell personal information for money.
- We honor right-to-be-forgotten requests promptly, generally within about 30 days, and notify of security incidents without undue delay.
- Sub-processors are engaged by category — such as a cloud hosting provider, email delivery provider, payment processor, and analytics provider — and a current list is available on request.
- A signed DPA is available for customers who require one.

Third-party services and integrations
FUNEL connects with third-party services such as your CRM, email systems, and other tools you choose to integrate. Your use of those services is governed by their own terms and privacy practices, and FUNEL is not responsible for their availability, accuracy, or conduct.
When you enable an integration, you authorize FUNEL to exchange data with that service as needed to provide the connected functionality. You are responsible for maintaining your own accounts and permissions with those services and for ensuring your use of them complies with their terms. If a third-party service changes or becomes unavailable, related features in FUNEL may be affected.
Disclaimers of warranties
The service is provided "as is" and "as available" without warranties of any kind. FUNEL does not guarantee any specific business result, nor the accuracy, completeness, or deliverability of any contact record, enrichment, or outreach campaign. You use the service and the data it produces at your own discretion and risk.
To the fullest extent permitted by law, we disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that data drawn from public sources is current or applicable to your intended use. Any service-availability target we mention is a goal, not a contractual guarantee, except where stated in a separate written agreement.
Limitation of liability
To the maximum extent permitted by law, FUNEL's total liability arising from or relating to the service is limited to the amount of fees you paid to FUNEL in the 12 months before the event giving rise to the claim. FUNEL is not liable for any indirect, incidental, special, consequential, or punitive damages.
This includes, without limitation, lost profits, lost revenue, lost data, business interruption, or loss of goodwill, whether based in contract, tort, or any other legal theory, and whether or not we were advised of the possibility of such damages. These limits apply to the fullest extent permitted by applicable law; some jurisdictions do not allow certain exclusions, in which case the limitations apply only to the extent allowed.
Indemnification
You agree to defend, indemnify, and hold FUNEL harmless from any claims, damages, losses, liabilities, and reasonable costs (including legal fees) arising from your use of the service, your content or data, your outreach activity, or your breach of these terms or applicable law.
This obligation specifically includes claims arising from how you use exported contact data, your email and marketing campaigns, your failure to honor opt-out or objection requests, and any violation of anti-spam, marketing, or data-protection laws. We will notify you of any such claim and may, at our option, participate in the defense with counsel of our choosing.
Suspension and termination
We may suspend or terminate your access if you breach these terms or the Acceptable Use Policy, fail to pay fees, or use the service in a way that creates legal or security risk. You may stop using the service and cancel at any time as described in the billing section.
- We may suspend access immediately where needed to protect the platform, other customers, or third parties, and will aim to give notice where practical.
- On termination, your right to use the service ends and outstanding fees become due.
- Following termination, we retain or delete data in accordance with our Privacy Policy and DPA, and honor deletion requests promptly.
- Sections that by their nature should survive termination — including intellectual property, disclaimers, liability limits, and indemnification — continue to apply.
Governing law and dispute resolution
These terms are governed by the laws of the jurisdiction in which FUNEL is established, without regard to conflict-of-law rules. Any dispute arising from or relating to these terms or the service will be resolved in the courts or forums of that jurisdiction, unless mandatory local law gives you other rights.
Before pursuing formal proceedings, the parties agree to attempt in good faith to resolve any dispute informally by contacting support@funel.to. If the dispute cannot be resolved within a reasonable period, either party may pursue the remedies available under the governing law. Nothing in this section limits any non-waivable rights you have under the law applicable to you.
Changes to these terms
We may update these terms from time to time to reflect changes in the service, the law, or our practices. When we make material changes, we will update the effective date and provide reasonable notice, such as by email or an in-product notice.
Your continued use of the service after the updated terms take effect constitutes acceptance of the changes. If you do not agree to the revised terms, you should stop using the service and cancel your subscription before they take effect.
